What you need to know now

A tax residency certificate is requested for a defined period and purpose. Domestic residency and treaty eligibility require distinct analysis.

  • A residence visa alone does not settle every tax-residency question.
  • Identify the treaty and counterparty jurisdiction where relevant.
  • Prepare evidence appropriate to the applicant and period.

Define the purpose before applying

A Tax Residency Certificate should answer a specific question for a specific period. Identify whether it is needed for a foreign tax authority, treaty claim, bank or another recipient, and obtain that recipient’s requirements before starting. A certificate requested for domestic purposes and evidence supporting a particular treaty position may involve different analysis. Do not assume that a UAE residence visa, company licence or an account balance settles every residency question.

Assemble evidence for the applicant

Create a file appropriate to the individual or legal entity applying. For an individual, organise relevant identity, immigration, accommodation and personal or economic connection evidence for the period. For a company, keep incorporation information and evidence relevant to its management and operations. Match document dates to the requested certificate dates. Where travel history or another record appears inconsistent, explain the difference rather than submitting disconnected documents and expecting the reviewer to infer the chronology.

Check treaty and overseas implications

If the certificate will support relief under a double-tax agreement, identify the agreement and the particular income or claim involved. Ask what the overseas recipient needs in addition to the certificate, such as its own form or beneficial-ownership information. A certificate does not decide every foreign filing obligation or guarantee that the other country will grant relief. Keep advice about the foreign position distinct from the UAE certificate application and retain both conclusions.

Submit a consistent application

Use the current FTA certificate service and review the applicant’s name, period, purpose and attachments before submission. Keep the application reference and respond coherently to requests for further information. After issue, verify the certificate details before forwarding it to the intended recipient. Store it with the supporting evidence and note when the recipient needs a later period covered. Do not reuse an old certificate as proof for an unrelated year or purpose. Keep a note of the intended recipient’s requirements so an application is not repeated simply because the wrong period or purpose was selected.

UAE Tax Residency Certificate: Tax Domicile Certificate

UAE Tax Residency Certificate : In line with the Cabinet Decision No. 65 of 2020 on Fees for Services provided by the Federal Tax Authority issued in October 2020. The Federal Tax Authority (FTA), and in coordination with the Ministry of Finance (MOF) will start receiving applications for the issuance of tax certificates via its website as of 14th November 2020.

There are two categories of tax certificates which will be issued to Legal and Natural Persons:
• Tax Residency Certificate: a certificate issued by the FTA upon request to enable applicants to benefit from Double Tax
Avoidance Agreements (DTAA) on income signed by the UAE.
• Commercial Activities Certificate: a certificate issued by the FTA to enable applicants to refund VAT paid outside the UAE, whether or not DTAAs are applicable. The new service provides advantages and ease for the issuance of certificates to those registered in the tax system, as all their data is available in the FTA database so they can apply for Tax Certificates through direct and quick digital procedures.
