What you need to know now

Commercial property rent is generally standard-rated; residential rent is generally exempt. The first qualifying supply of a new residential building can be zero-rated.

  • Classify the actual property and use.
  • Check first-supply conditions rather than assuming all housing is exempt.
  • Assess mixed-use areas and supporting records.

Classify the property and the particular supply

Commercial and residential property can have different VAT treatment. The review should identify the building’s relevant characteristics and the transaction being made, rather than relying only on how the property is described in an advertisement. Rent, sale and a package of accommodation services may present different questions.

Collect the title, completion information, lease or sale agreement and evidence of use. Where a building has mixed areas or different arrangements, assess those elements rather than assigning one code to every receipt. A property register can make the classification review easier to maintain across a large portfolio.

Check first-supply conditions separately

Residential property is not accurately described by one blanket statement that all transactions are exempt. The first qualifying supply of a new residential building may be zero-rated. Review the statutory conditions, timing and evidence before applying that treatment to an individual sale or lease.

Keep completion and prior-supply records accessible, especially where the property has changed owner or managing agent. An assumption based on the building looking new is not a substitute for evidence. If the history is incomplete, identify what needs to be confirmed before the invoice or tax conclusion is finalised.

Review serviced arrangements and shared costs

Serviced accommodation requires careful attention to what is supplied beyond occupation of the premises. Describe the services, supplier and contract structure. Do not assume every apartment is residential for VAT merely because a person sleeps there, or that every separately described service follows the same treatment as rent.

Input-tax recovery should also be reviewed separately. Direct costs and shared property overheads can support different activities. Retain the basis for allocating shared expenditure and review it when the use or income mix changes. A supplier invoice alone does not settle the recovery treatment for every property cost.

Connect the property file to billing and accounting

Configure the billing system from the documented property review, and keep a process for reporting changes in use or contract terms. Leasing teams should know when a proposed package, concession or service requires finance input. This is easier than correcting inconsistent tax treatment after several invoices have been issued.

At period end, reconcile the property income schedule to the ledger and VAT workpaper. Review credits, deposits and unusual receipts with their supporting agreements. The original 2017 clarification provides historical context, while the current conclusion needs to reflect the actual property, transaction and legislation applicable to its period.

Federal Tax Authority Clarifies Regulations Regarding VAT for the Real Estate Sector

UAE VAT for Real Estate Sector : Abu Dhabi, November 18, 2017– The Federal Tax Authority (FTA) has clarified regulations pertaining to Value Added Tax (VAT) when it comes to the real estate sector, stating that the supply of commercial real estate (selling or leasing) will be subject to the basic 5% tax rate, while residential units will remain generally exempt, except for the first supply of a new residential building within the first three years of it being constructed which will be 0% rated.

Residential and Commercial Buildings

The FTA defines the supply of real estate as activities that include, among other things, the sale, lease or giving of the right to any real estate.

A residential building is a building or part thereof that is intended and designed for occupation by individuals, and mainly includes buildings that can be occupied by any person as the main place of residence. This does not include any place that is not a building fixed to the ground and that can be moved without being damaged; any building that is used as a hotel, motel, bed and breakfast establishment, hospital or the like; a serviced apartment for which services in addition to the supply of accommodation are provided; and any building constructed or converted without lawful authority.

Meanwhile, a commercial building is any building or part thereof that is not a residential building. Examples include offices, warehouses, hotels, shops, etc.
